The Charlottesville planning commission re-wrote an ordinance, viewed in January, that could change where the popular food trucks could do business in Charlottesville.</p>
<p>The ordinance would allow food trucks to park in residential areas with a special permit. Trucks would be allowed to operate within 100 ft. of a home.</p>
<p>The food trucks must also be at least 30 feet away from restaurants. One local food truck owner spoke about the affect of the ordinance.</p>
<p>&#8220;It will open up the possibility that food trucks like ourselves will be able to vend on private lots with the permission of property owners,&#8221; says Mouth Wide Open owner Justin Wert. &#8220;That would give us an opportunity to vend downtown without having to worry about two hour parking, so that would be a big assistance to us.&#8221;</p>
<p>The city of Charlottesville and the Virginia Health Department will issue those permits for parking in residential areas.</p>
<p>The ordinance is supposed to go in front of city council later in the spring.</p>

<p style="text-align: justify;">Mobile food trucks in <a href="http://www.cvillepedia.org/mediawiki/index.php/Charlottesville" target="_blank">Charlottesville</a> edged one step closer to reality after a <a href="http://www.cvillepedia.org/mediawiki/index.php/Planning%20Commission" target="_blank">Planning Commission</a> vote Tuesday.</p>
<div style="text-align: justify;">The commission recommended approval of a zoning ordinance to create a system to allow the trucks, which have grown in popularity across the country.</div>
<div style="text-align: justify;"></div>
<div style="text-align: justify;">“I think this is a good way to dip our toe into the water to see what’s going to work for our community,” said Commissioner <a href="http://www.cvillepedia.org/mediawiki/index.php/Natasha%20Sienitsky" target="_blank">Natasha Sienitsky</a>.</div>
<div style="text-align: justify;"></div>
<div style="text-align: justify;">The commission initially reviewed the ordinance in January, and sent it back for several changes.</div>
<div style="text-align: justify;"></div>
<div style="text-align: justify;">Staff rewrote the ordinance to prohibit the operation of food trucks in residential areas without a special use permit. In addition, trucks will not be allowed to operate within 100 feet of a home.</div>
<div style="text-align: justify;"></div>
<div style="text-align: justify;">The city asked for input from more than 250 restaurant owners on the proposed ordinance, but only two responded. Despite that, the ordinance is written so that food trucks must be at least 30 feet away from restaurants.</div>
<div style="text-align: justify;"></div>
<div style="text-align: justify;">“We’re just trying to watch out for the brick-and-mortar community,” said Reed Brodhead, the city’s zoning administrator. “This gives them a little barrier.”</div>
<div style="text-align: justify;"></div>
<div style="text-align: justify;">Mayor <a href="http://www.cvillepedia.org/mediawiki/index.php/Satyendra%20Huja" target="_blank">Satyendra Huja</a> said he did not support that restriction.</div>
<div style="text-align: justify;"></div>
<div style="text-align: justify;">“In a democratic society, you’re supposed to be able to compete,” he said.</div>
<div style="text-align: justify;"></div>
<div style="text-align: justify;">However, Commissioner <a href="http://www.cvillepedia.org/mediawiki/index.php/Lisa%20Green" target="_blank">Lisa Green</a> said she could support an even greater distance between mobile trucks and restaurants.</div>
<div style="text-align: justify;"></div>
<div style="text-align: justify;">“We pride ourselves on having great restaurants and we don’t want to see those go away,” she said.</div>
<div style="text-align: justify;"></div>
<div style="text-align: justify;">Both the city and the Virginia Health Department will issue permits, and those from the city will need to be reviewed yearly.</div>
<div style="text-align: justify;"></div>
<div style="text-align: justify;">Commissioner <a href="http://www.cvillepedia.org/mediawiki/index.php/John%20Santoski" target="_blank">John Santoski</a> asked how mobile food trucks would be prevented from becoming permanent fixtures at any location. Brodhead said the Virginia Department of Health requires trucks to return to a commissary every day to dump liquids and be cleaned.</div>

<div style="text-align: justify;">One potential food truck operator spoke at the public hearing to say that staying in one place would be against her business plan.</div>
<div style="text-align: justify;"></div>
<div style="text-align: justify;">“We’re a kitchen and we want to bring food to people in different spots all the time,” said Keely Haas, whose application to create a business called the Morsel Compass is in process. She said she hopes to be in operation by April.</div>
<div style="text-align: justify;"></div>
<div style="text-align: justify;">Commissioner <a href="http://www.cvillepedia.org/mediawiki/index.php/Kurt%20Keesecker" target="_blank">Kurt Keesecker</a> said he supported the trucks, but wanted to know if Brodhead had considered noise that the trucks might generate.</div>
<div style="text-align: justify;"></div>
<div style="text-align: justify;">Brodhead said trucks that need to generate power would be subject to the city’s noise ordinance.</div>
<div style="text-align: justify;"></div>
<div style="text-align: justify;">Santoski also wanted property owners who give permission for food trucks to have some sort of written record, so the ordinance was adjusted.</div>
<div style="text-align: justify;"></div>
<div style="text-align: justify;">“I can see there being some gray area and some disputes arising over who is ultimately responsible [for cleaning up],” Santoski said.</div>
<div style="text-align: justify;"></div>
<div style="text-align: justify;">The vote to recommend approval of the ordinance was unanimous, though one commissioner had reservations.</div>
<div style="text-align: justify;"></div>
<div style="text-align: justify;">“My major concerns are trash, noise and litter and I think the ordinance takes care of those, with the exception of the generator,” said Commission Chairwoman <a href="http://www.cvillepedia.org/mediawiki/index.php/Genevieve%20Keller" target="_blank">Genevieve Keller</a>.</div>

<p style="text-align: justify;"><a href="http://www.cvillepedia.org/mediawiki/index.php/Charlottesville" target="_blank">Charlottesville</a> officials are seeking ways to amend the city’s code to support a new trend in casual dining.</p>
<div style="text-align: justify;">“Mobile food units are popping up in localities all over the country,” said Read Brodhead, the city’s zoning administrator. “Austin[, Texas,] has over a thousand mobile food trucks. D.C. has over 200. We have about six.”</div>
<div style="text-align: justify;"></div>
<div style="text-align: justify;">However, technically speaking, they are not allowed under the city’s zoning code.</div>
<div style="text-align: justify;"></div>
<div style="text-align: justify;">On Tuesday, Brodhead presented the <a href="http://www.cvillepedia.org/mediawiki/index.php/City%20Planning%20Commission" target="_blank">city Planning Commission</a> with proposed changes to the zoning code to allow food trucks to operate on private property within city limits.</div>
<div style="text-align: justify;"></div>
<div style="text-align: justify;">Brodhead said many communities have chosen to use the zoning code to prevent food trucks from operating. He said Charlottesville wants to take a different approach.</div>
<div style="text-align: justify;"></div>
<div style="text-align: justify;">“There is no desire to over-regulate,” Brodhead said. “The main purpose is to create an ordinance to make it legal and welcome these uses in the city.”</div>
<div style="text-align: justify;"></div>
<div style="text-align: justify;">Under the regulations Brodhead proposed, applicants would have to be certified by the health department and demonstrate they have permission from a private property owner. Applicants could operate in up to 10 locations per permit.</div>
<div style="text-align: justify;"></div>
<div style="text-align: justify;">Brodhead suggested that trucks not be allowed to provide any seating for diners, and that they would have to provide at least one trash receptacle. Trucks also would only be allowed in places with enough parking. The permits would be annual, giving the zoning staff a chance to reconsider issuing a new one if problems arise.</div>
<div style="text-align: justify;"></div>
<div style="text-align: justify;">Commissioner <a href="http://www.cvillepedia.org/mediawiki/index.php/Lisa%20Green" target="_blank">Lisa Green</a> wanted to know more information about how a permit could be granted to an operation that moves throughout the city.</div>
<div style="text-align: justify;"></div>
<div style="text-align: justify;">“When we do special-use permits, they go with the land,” Green said. “Does the landowner get the provisional permit? I’m not sure how this would work logistically.”</div>
<div style="text-align: justify;"></div>
<div style="text-align: justify;">Brodhead said the process would be similar to the provisional-use permits that allow for home occupations.</div>
<div style="text-align: justify;"></div>
<div style="text-align: justify;">“Enforcement might be difficult,” Brodhead said. “I hope it is easy. We want to create a simple one-page document to make it as easy as possible.”</div>
<div style="text-align: justify;"></div>
<div style="text-align: justify;">Other commissioners pointed out other concerns.</div>
<div style="text-align: justify;"></div>
<div style="text-align: justify;">Would food trucks be able to operate 24 hours a day?</div>
<div style="text-align: justify;"></div>
<div style="text-align: justify;">“A brick and mortar restaurant doesn’t have any regulations on the hours in which they can operate,” Brodhead said.</div>
<div style="text-align: justify;"></div>
<div style="text-align: justify;">What if a mobile food truck never moved?</div>
<div style="text-align: justify;"></div>
<div style="text-align: justify;">“There are restrictions in the health department permits that after a certain amount of hours they have to return to their commissary and flush the water and restock,” Brodhead said.</div>
<div style="text-align: justify;"></div>
<div style="text-align: justify;">After Brodhead said he had not been in touch with restaurant owners, City Councilor <a href="http://www.cvillepedia.org/mediawiki/index.php/Dede%20Smith" target="_blank">Dede Smith</a>encouraged him to do so.</div>
<div style="text-align: justify;"></div>
<div style="text-align: justify;">“It might be interesting to get their feedback,” Smith said.</div>
<div style="text-align: justify;"></div>
<div style="text-align: justify;">The idea had the support of the five planning commissioners present, but all felt more work is needed.</div>
<div style="text-align: justify;"></div>
<div style="text-align: justify;">“This is something that is much needed and really consistent with Charlottesville as the locavore capital of the world,” said Commissioner <a href="http://www.cvillepedia.org/mediawiki/index.php/Natasha%20Sienitsky" target="_blank">Natasha Sienitsky</a>. “I’d like to see this ordinance allow for some seating.”</div>

<div style="text-align: justify;">“I very much would like to do anything I can to promote a vital food cart culture,” said Commissioner <a href="http://www.cvillepedia.org/mediawiki/index.php/Michael%20Osteen" target="_blank">Michael Osteen</a>. He added that he would also support some seating at food carts.</div>
<div style="text-align: justify;"><a href="http://www.cvillepedia.org/mediawiki/index.php/Genevieve%20Keller" target="_blank">Genevieve Keller</a>, chairwoman of the commission, said she would favor involvement from property owners.</div>
<div style="text-align: justify;"></div>
<div style="text-align: justify;">“[What if] there’s an overflow of trash, the truck drives away, and there’s a lot of trash there?” Keller asked.</div>
<div style="text-align: justify;"></div>
<div style="text-align: justify;">Green, a supporter of food trucks in general, said she was not inclined to allow seating because that could compete with downtown merchants.</div>
<div style="text-align: justify;"></div>
<div style="text-align: justify;">“I don’t want to take away from that,” Green said. She also wanted to make sure trucks did not block sidewalks or bike lanes.</div>
<div style="text-align: justify;"></div>
<div style="text-align: justify;">However, commissioners said the proposed ordinance change was not ready in part because more scrutiny of the relationship between food trucks and private property is needed.</div>
<div style="text-align: justify;"></div>
<div style="text-align: justify;">“To the degree that it is anchored to the land is pretty important,” said <a href="http://www.cvillepedia.org/mediawiki/index.php/David%20Neuman" target="_blank">David Neuman</a>, the architect for the University of Virginia. “When there are more than one of them in one spot, there’s more opportunity for some related effects in terms of trash and the like, and the need for seating.”</div>

<div style="text-align: justify;">Deputy City Attorney Rich Harris said he also had several issues with the ordinance as suggested.</div>

<div style="text-align: justify;">“It looks like there’s going to be a lot of rewrites in the draft that will come back before you,” Harris said.</div>

<div style="text-align: justify;">A rewritten ordinance will come  back to the Planning Commission later this year for a second public hearing.</div>

<p style="text-align: justify">Charlottesville is looking at making additions to its zoning ordinance to accommodate the growing market of mobile food trucks.</p>
<p style="text-align: justify">At Monday night&#8217;s city council meeting, zoning administrators will initiate a study to determine where mobile food units are allowed in the city.  The purpose of having the mobile food unit ordinance is to provide guidelines on where food trucks can park on public and private properties across the city.</p>
<p style="text-align: justify">Jim Tolbert, director of the Charlottesville&#8217;s Department of Neighborhood Development Services, said, &#8220;Technically, we don&#8217;t have anywhere where they&#8217;re allowed on private property. We&#8217;re also coming back with an ordinance that would regulate where they&#8217;re allowed to park on the street.&#8221;</p>
<p style="text-align: justify">Neighborhood development staff wanted to address the issue now because the city has received a number of calls from prospective food truck owners.</p>

<p style="text-align: justify;"><a href="http://www.MobileFoodNews.com/wp-content/uploads/2011/09/GOT-DUMPLINGS-LOGO.jpg"><img class="size-large wp-image-21513 alignleft" title="GOT DUMPLINGS LOGO" src="http://www.MobileFoodNews.com/wp-content/uploads/2011/09/GOT-DUMPLINGS-LOGO-500x280.jpg" alt="" width="300" height="168" /></a>With Newcomb Hall undergoing an $18 million renovation, UVA Dining  Services came up with a student meal solution that falls decidedly  outside of the lunchbox. Beginning this fall, on weekdays from 11am to  2pm, six trucks with names like Steak Me Home Tonight, Got Dumplings?  and Nacho Panda—park around the UVA Amphitheater to offer students a  variety of foods, from Asian-style dumplings to homemade doughnuts.</p>
<p style="text-align: justify;">“We looked at other ways of building capacity at lunch  time when we need to feed so many students,” said Brent Beringer, UVA  Dining Services director.  “It seemed to be a good fit, and it was  something that we wanted to try anyway.”</p>
<p style="text-align: justify;">Beringer said food trucks have become familiar thanks to  heavy media coverage—take, for instance, “The Great Food Truck Race.”  Beringer said UVA could have installed a temporary facility to deal with  the Newcomb renovation, but instead opted to offer meals on wheels.</p>
<p style="text-align: justify;">“It’s just on the forefront,” he said. “It’s new, it’s exciting and it feels fresh to students.”</p>
<p style="text-align: justify;">Judging by the scene on a recent afternoon, the students  like their options. About 25 people stood in line for a taste of the  popular Got Dumplings? menu—chicken curry pork or shrimp and chives  dumplings. Sophomore Nicholas Williams, who ordered a Korean BBQ  quesadilla, said having food trucks is not only “innovative” and  “convenient,” but also a lesson in personal finance.</p>
<p style="text-align: justify;">“It teaches [students] to balance their money and it gives  them a different feel of food,” he said. Sophomore and food truck  newbie Britton Vermaaten, who settled on a BBQ hot dog and a Dr. Pepper  from Steak Me Home Tonight, said the trucks “add a lot of diversity to  the food choices” at UVA and “they are pretty well priced.”</p>
<p style="text-align: justify;">If the options give UVA students a bit  more convenience, they pose a new challenge to the cooks. Joseph Mills,  owner of Last Call Dogs and co-owner of Nacho Panda, said his team has  had to refocus its strategy to offer quicker, more efficient service.</p>
<p style="text-align: justify;">Paying for food truck meals has also gotten quicker.  Beringer said all trucks are now part of the University Meal Plan, and  accept “Plus Dollars,” which students can use for University meal  options outside of the dining halls. “That’s a benefit to [the food  trucks], and in return they pay a commission to the University,” said  Beringer.</p>
<p style="text-align: justify;">Although Beringer said vendor agreements would not allow  him to share financial information, he said sales have already exceeded  expectations in just a few weeks.</p>
<p style="text-align: justify;">“There are lines out there every day.”</p>
<p style="text-align: justify;">Mills, who opened Last Call Dogs in 2008, said he is  interested in expanding and bringing in more diverse food choices. “We  are excited to be on the leading edge of it, and we look forward to  getting bigger and better in the future,” he said.</p>
<p style="text-align: justify;">As for the future of food trucks at UVA, Beringer said it  will depend on whether students still find them exciting a year from  now, and whether this “kind of commercial activity that happens so close  to the Lawn,” fits the school’s long-term vision. However, Beringer  said additional local vendors have expressed interest in joining the  program.</p>
